End-User License Agreement (EULA) for lybxlpsv’s frame generation:

By using lybxlpsv's frame generation ("the Application"), you agree to the following terms:

1. Grant of License & Restrictions

1. Proprietary Rights: The Application and all documentation are the exclusive property of lybxlpsv’s Software. You are granted a limited license to use the software; you do not own it.
2. One License Per Device: Each license key is valid for use on one device only and is non-transferable between devices. While the license cannot be migrated to different hardware by the user, it remains associated with the original hardware and may be transferred to a subsequent owner of that specific device upon sale or transfer of the hardware.
   Any other instance of license migration is strictly a discretionary exception granted only under verified, extraordinary circumstances (e.g., documented hardware failure). Furthermore, such exceptions may only be considered within a limited window following the original purchase date. If an exception is authorized, the previous license instance will be permanently deactivated. We reserve the right to deny any transfer request at our sole discretion to prevent service abuse or to account for the age of the original license.
3. No Tampering or Redistribution: You agree not to reverse engineer, modify, or redistribute the Application without prior written permission.

2. Payments, Chargebacks & Merchants of Record

1. Third-Party Processing: Payments are processed either by independent third-party Merchants of Record (such as Google Play, LemonSqueezy, or Patreon) or through our local payment gateway, depending on the purchase method selected. The applicable payment provider acts as the seller or processor of record and is solely responsible for payment processing, billing, taxes, refunds, and related compliance. All transactions are subject to the payment provider’s terms in effect at the time of purchase, which are presented at checkout and incorporated into this Agreement. By completing a transaction, you agree to those terms.
2. Delays & Disputes: While we aim for a smooth experience, payment processing is handled entirely by the platform (e.g., Google or Patreon). We aren't responsible for bank rejections or delays caused by their security checks. Your license will activate automatically as soon as the platform sends us a "settled" confirmation. If you’ve been charged but your license is missing, please contact support with a valid proof of purchase; we will investigate the discrepancy to ensure your access is manually restored or the license is correctly provisioned to your account.
3. Chargeback Policy: If a chargeback or payment dispute is detected, your license and all rights under these terms are immediately voided. All services will be terminated, and we reserve the right to cease all further communication and support without notice.

3. Refunds & Statutory Rights

1. Discretionary Refunds: We do not guarantee refunds. Any refund or license replacement is at our sole discretion. We strongly recommend using the trial/demo version before purchasing.
2. Activation Waiver: Per consumer protection laws for digital content, your right to a "cooling-off" period expires once you activate the license key. By activating, you waive your right to a refund based on a "change of mind."
3. Platform Control: All refund processing is managed exclusively by the Merchant of Record (Google, Patreon, etc.). Even if we authorize a refund, we cannot be held responsible for a platform's refusal or delay in returning funds. Please note that any issued refund may be subject to the platform’s policies regarding non-refundable transaction fees or currency conversion differences, which may result in a refund amount lower than the original purchase price.

4. Warranty & Liability

1. "As-Is" Provision: The Software is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including merchantability or fitness for a particular purpose.
2. Limitation of Liability: To the maximum extent permitted by applicable law, lybxlpsv shall not be liable for any direct, indirect, incidental, or consequential damages (material or immaterial) arising from the use or inability to use the Software.

5. Termination & Governing Law

1. Termination: We reserve the right to terminate your license immediately for violations of these terms or payment-related issues.
2. Governing Law: These terms shall be governed by the laws of your local jurisdiction, except where preempted by the terms of the Merchant of Record (e.g., Google Play’s Developer Distribution Agreement).

Terms of Service

By using the lybxlpsv’s online services, you agree to the following terms:

1. Age Requirement: Users must be at least 13 years old to use the Application.
2. Account Responsibility: You are responsible for maintaining the security of your account and all activities that occur under your account.
3. Service Interruption: The online services may be shut down at any moment without prior notice.
4. Backup Responsibility: Users are responsible for backing up their license information in case of service interruption.

Privacy Policy

We are committed to protecting your privacy. By using the Application, you agree to the collection and use of information in accordance with this policy.

1. Stored Device Data: We may collect device serial numbers, device model and device specifications for licensing purposes. This data is never shared with third parties. However, we may utilize device specifications data for statistical purposes to improve our services.
2. Stored Personal Data: We may collect OAuth IDs, names, and optional email addresses for authentication and account recovery purposes. This data may be shared with related third parties for the same purposes.

Current Third Party OAuth Providers: Google (id), Patreon (id, name optional, e-mail optional), Telegram (id).

3. Temporary Logs:  User Data (name and email) is only logged during the initial sign-in process. Because sign-in is not required for software license verification, no personal user data is logged during routine use or validation. During these processes, logging is limited strictly to license status and device information
4. Cookies: We may use cookies to enhance your experience while using the Application. These cookies are used for authentication and session management purposes.
5. IP Address Collection: We collect IP addresses for security and authentication purposes. This information helps us detect and prevent unauthorized access to your account and improve server performance.
6. Screen Contents: The screen content and the currently running application ID or name are stored and processed ephemerally, remaining entirely on your device. This data is used solely for the functionality of this software and is never stored or transmitted elsewhere.
7. Information Page Content Retrieval: Within our software, the information page connects to our servers to retrieve and display text and images. When you access any “online” page within this software, a unique identifier corresponding to the page content is sent to our servers solely for the purpose of fetching and displaying the relevant information. This process is strictly limited to content delivery and does not involve the storage or processing of any personally identifiable information.
8. Local Application Listing and Name Transmission: Within our software, your device’s application list is stored and processed locally. When you select an application from this list, the chosen app name is transmitted to our servers solely to provide tailored guidance and troubleshooting support. This data is used only for the immediate purpose of enhancing your user experience and is not retained or stored beyond the session. No personally identifiable information is collected during this process.
9. Online Diagnostics: Our software includes an optional online diagnostics feature designed solely to assist with troubleshooting. When you use this feature, your device and operating system related specifications are automatically transmitted to our servers for processing. This data is used only to generate relevant troubleshooting information and is not stored or retained beyond the duration of the session. No personally identifiable information is collected or transmitted at any point.
10. Support & Communication: When contacting support via third-party platforms (Telegram, Patreon, or email), you acknowledge that these channels carry inherent security risks. You agree that we are not responsible for data breaches or unauthorized disclosures occurring on these external platforms. For maximum security, email is recommended. You may request the deletion of our email history at any time, subject to legal requirements; for other platforms, please utilize their native data deletion tools. By reaching out, you accept responsibility for selecting the communication channel that best meets your privacy needs.

3rd Party Data Processors & Sub-processors
To provide our services, we share certain data with third-party service providers who act as Data Processors or Merchants of Record. These partners are selected for their high security standards and are contractually obligated to protect your data according to global privacy regulations.

Data Deletion

To request data deletion, please email deletion request at lybxlpsv dot com (without the space), or via patreon chat with the same patreon account you use while pledging.

Important Notes:

1. Free Users: We do not store personally identifiable data for free users; no action is required.
2. Retention for Bookkeeping: For Patreon users, we retain your Patreon ID and total points spent. This is essential for transaction integrity and to prevent service abuse.
3. Full Removal: Requesting full data removal will permanently delete your user profile, anonymize order details, and revoke all active licenses and services.
4. Third Parties: We cannot delete data held by third-party providers (Google, Patreon, etc.). You must contact them directly to manage their records.
5. Response Time: We will fulfill verified requests within 30 days.

If you are a California resident, you have the right to access, delete, or correct your personal data.

• No Sale of Information: We do not sell, rent, or share your personal information with third parties for their own commercial use. We only share data with the service providers listed in this policy to perform essential functions (like payments and licensing).

MODIFICATION OF THE TERMS & CONDITION AND EULA:
Your continued use of the software is conditioned on your acceptance of the most current version of this End-User License Agreement ("EULA"). We reserve the right to modify, update, or discontinue any part of this EULA—including its terms, conditions, and notices—at any time without prior notice or further obligation, except as otherwise provided herein. Upon each application launch, the updated EULA will be presented with an "Agree" option. If you do not accept the updated terms, you are required to exit the application and discontinue use of the software.

We’re a small, independent operation—essentially a single-person business—with limited legal resources.
